What powers are available to the National Park Authority?
We have statutory powers to investigate unauthorised
developments and the discretion to take appropriate remedial action.
Investigations can be complex and lengthy and the use of enforcement powers should always be proportionate to the breach of planning control. For
instance, we would not expect to take enforcement action against minor breaches
with no adverse impact on the surrounding character or amenity, or simply to
regularise a development.
We always seek to bring about voluntary resolution through
informal discussion and negotiation and except where serious amenity,
environmental or safety issues are raised, formal enforcement action is always
a last resort.
We hold
a public Enforcement Register with a summary of enforcement notices
that have been served by the National Park Authority since 2003. It is available to view in our Headquarters
in Balloch.
